주소(住所)는 거주소(居住所)의 준말로, 사람이 사는 곳이나 기관, 회사 따위가 자리 잡고 있는 위치를 일정한 형식의 거리 이름과 행정 구역으로 나타낸 정보의 집합체이다. 또한 어떠한 주소에는 우편 번호와 같이 우편물과 포장물의 이동을 도와주는 특별한 부호가 포함되어 있기도 하다.

개요

주소는 생활의 근거(根據), 즉 사람이 일상생활을 영위하고 또 사회적 활동을 할 때의 장소적 중심을 가리킨다. 주거를 정하고 생활의 도구를 비치하여 가정을 가지고 있는 곳으로서 보통 사람에게는 하나뿐이겠으나 예컨대 대부분의 변호사처럼 가정과 별도로 법률사무소를 가지고 있는 사람과 같은 경우를 보면 일상의 가정생활 관계의 것과 전문적인 직업관계의 것으로 각각 그 사정에 따라 주소가 두 개 있는 것으로 인정할 수가 있으며 또 그 편이 편리하기도 하다.

주소는 여러 가지 법률상의 문제에서 기준의 지점(地點)이 된다. 이를테면 다음과 같다.

1. 부재자(不在者)·실종자(失踪者)에서는 종래의 주소를 떠나서 당분간 돌아올 가망이 없는 자로 되어 있다.
2. 차금(借金)을 갚는 등의 채무를 이행하는 장소는 원칙적으로 채권자의 주소이다(467조).
3. 상속개시의 기준지(其準地)(998조), 따라서 상속에 대한 소(訴)는 피상속인의 보통재판적(普通裁判籍) 주소지의 법원에 제기한다(민소 20조).
4. 일반의 소는 원칙적으로 피고의 보통재판적 주소지의 법원에 제기한다(민소 2조).

그러나 행상인(行商人)과 같이 생활의 본거가 일정하지 않은 자도 있다. 이러한 자는 주소를 정할 수가 없기 때문에 대신 상당히 계속적으로 체류하여 대체적으로 그 사람의 생활의 기준이라고 볼 수 있는 지점을 '거소(居所)'라고 부르며 이 거소를 가지고 주소로 간주하기로 되어 있다(19조). 그리고 한국에 주소를 갖지 아니한 자는 한국인이나 외국인이나 그 사람이 한국에서 가지고 있는 거소를 주소로 간주하여 취급한다(20조). 또한 일반의 주소 외에 어떠한 특정 거래 등의 경우에 당사자가 편의상 특별히 일정한 지점을 기준으로 정하는 일도 있다. 이것을 '가주소(假住所)'라고 부르며 그 거래에 관한 한 주소와 마찬가지로 취급된다(21조). 예컨대, 서울 사람과 부산 사람이 상품을 매매할 때에 인천을 가주소(假住所)로 정하면 그 매매에 관한 한 인천이 기준점이 되고 목적물은 인천에서 인도하고 대금을 지급하며, 분쟁이 있는 때에는 인천의 보통재판적 법원에 소송을 제기하게 된다.
